What RERA Covers

RERA (2016) is mandatory for: All residential projects with plot area > 500 sq mt or 8+ apartments, commercial real estate. Exemptions: renovation/repair, projects < 8 units on < 500 sq mt. All states have own RERA authority. Maharashtra, Karnataka, UP, Gujarat have active portals.

Check RERA Registration of Project

Visit your state RERA portal (e.g., maharera.mahaonline.gov.in). Search by project name, builder name, or registration number. RERA registration shows: Project details, approved layout, completion date, financial details, quarterly update by builder. Always buy in RERA-registered projects.

Your Rights as a Buyer Under RERA

Right to information: Access all project documents. Right to withdraw: Full refund + 10.9% interest if builder delays/defaults. Right to compensation: Compensation for structural defects within 5 years of possession. Right to 70% fund protection: Builders must keep 70% of collections in escrow.

File a RERA Complaint

File complaint on state RERA portal against builder for: delay, false advertising, change in approved plans, quality issues, refusal to give possession. Attach supporting documents. Pay nominal filing fee (₹1,000–₹5,000). RERA authority must decide within 60 days.

Can I get a refund if the builder delays possession by more than 1 year?

Yes. Under Section 18 of RERA, if the builder fails to complete or hand over possession on time, the buyer is entitled to a full refund of the amount paid with interest at SBI MCLR + 2% (currently around 10.9%). File complaint with state RERA authority.
